The Rule of Law

The legal system in Teneborough and the area under their jurisdiction is one of tort law, as in many places in the Republic.

Almost any tort may be settled in a private court by an arbitrator agreeable to both parties. If such an arbitrator cannot be found, the tort may be brought to the Magistrate of Teneborough. Persons or groups who bring torts found to be in bad-faith by the court may be fined.


State Torts must be pursued by the Magistrate of Teneborough or other appropriate Republic Official. A member of the assembly, usually the Interior Minister, may act as Prosecutor, arguing on behalf of the administration against the tortfeasor(s). Any other tort against the Administration of Teneborough may also be pursued.

Republic Laws and the Beneficium supersede all laws, rules, and regulations of the Administration of Teneborough.


Terminology & Definitions

Tort:
A wrongful or harmful act upon another, or infringement of a right. A tort only occurs when a Duty of Care exists, a breach of that duty can be reasonably asserted, and a harmful consequence has occurred (Causation).

Tortfeasor:
A person who commits a tort, sometimes called a Criminal.

Duty of Care:
The expected behavior of any responsible and reasonable Republic citizen, such as warning a passing traveller that a group of tormented are on the road ahead.

Breach of Duty:
A condition that exists when it can be reasonably proven or argued that a person or persons failed to meet the Duty of Care in a given scenario.

Causation:
A reasonable or probable harmful consequence as a result of a person or persons breach of duty. Such as being attacked by a group of tormented after a passer-by failed to warn you.

State Torts

Murder.

The act of wilfully causing the death of another human by direct or indirect action except in those cases of self-defense or provably for the public good.

Possible Penalties: Execution, Maiming / Blinding, Exile for Life,

Manslaughter.

The act of accidentally causing the death of another human by direct or indirect action.

Possible Penalties: Execution, Maiming/Blinding, Exile for Life, fine or public servitude equal to no less than 100 gold.

Sabotage

The Act of willingly or accidentally causing damage to public property, causing the death of or harm/injury of a public servant in the course of their duties, or other such acts as meeting the burden of proof to be determined worthy of pursuit by a Prosecutor.

Possible Penalties: Execution, Maiming/Blinding, Financial Restitution to the state to the amount of the damages.

Flight from Justice

The act of a Tortfeasor, especially state Torts, of willfully avoiding court or fleeing from a rightwise law enforcement agency.

Possible Penalties: Maiming / Blinding, A fine equal to no less than 50 silver.

Violation of the Beneficium

Any violation regarding the Laws of the Republic.

Penalties: Penalties will be imposed as appropriate per traditional standards in our most beloved Republic.

Armor Ordinance
